Art. 1.: This PRIVACY POLICY (hereinafter referred to as the “ Policy ”) has been adopted by “ Proxima BG ” Ltd , with UIC 131085505 , (hereinafter referred to as “ PROXIMA BG ” ), in its capacity as a personal data controller, in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “EU General Data Protection Regulation” or “ GDPR ”) and the Personal Data Protection Act (hereinafter referred to as the “ PDPA ”).
Art. 2. (1): PROXIMA BG respects the right to privacy of all individuals. Regardless of whether you are a client of the services we offer or just use them, you are protected by this Privacy Policy. It provides information on the way in which PROXIMA BG processes your personal data, regardless of whether you are our client, user of our websites or a contractor . PROXIMA BG strictly implements the applicable provisions of national and European legislation regarding the protection and secure storage of personal data of employees, contractors and partners, as well as individuals who have provided their personal data through the communication forms on the website with the address https://proxima-bg.com/ (below “SITE”).

WHEN WE PROCESS PERSONAL DATA
Art. 6.: PROXIMA BG collects only those personal data that are necessary to carry out the relevant lawful activities of the company. The activities related to the use of the SITE, in which personal data is processed, are related to the SITE communication forms specified below.
INDIVIDUALS WHOSE PERSONAL DATA WE PROCESS
Art. 7.: PROXIMA BG mainly processes personal data that you, as our client, provide to us voluntarily in the course of our business relationship, or you have filled out an inquiry form on our SITE . We may also receive information containing your personal data from our business partners in the supply chain or from public registers.
The personal data we collect about you are:

PURPOSES OF PROCESSING
Art. 9.: PROXIMA BG processes personal data only for specified and legitimate purposes and does not further process it in a manner incompatible with the stated purposes. PROXIMA BG processes personal data, including that obtained through the SITE, for the following purposes:
- Providing information about the company’s services in case of a request received;
- Establishing contact with persons who have expressed interest in the services of PROXIMA BG, with a view to the company’s commercial activities;
- Establishing contact with potential contractors or users through communication forms, including those of the SITE, including when requesting consent to receive messages from the SITE;
- Selection of employees by employment relationship.
LEGAL GROUNDS FOR PROCESSING
Art. 10.: PROXIMA BG processes personal data of data subjects on the basis of Article 6, paragraph 1, letter “b” and letter “f” of the GDPR, namely:
(b) processing is necessary for the performance of a contract to which the data subject is a party, or in order to take steps at the request of the data subject prior to entering into a contract;
(f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

Art. 11.: Disclosure of your data to third parties
PROXIMA BG discloses your personal data only in the following cases: only to state authorities, institutions and persons to whom we are obliged to provide personal data by law; – to persons who, on assignment, maintain equipment, software and hardware used for processing personal data; – to our partners who work on behalf of PROXIMA BG on the basis of contractual relationships and help us provide you with our services and with whom we have agreements to maintain the confidentiality of information and protect personal data.
PROXIMA BG takes measures to ensure that all these persons apply the same protection to your
personal data as our own employees and comply with the Personal Data Protection Policy.
PERSONAL DATA STORAGE PERIOD
Art. 12.: The duration of storage of personal data depends on the purposes of the processing for which they were collected and for the period specified in the applicable laws. In cases where there is no such legal period, PROXIMA BG assumes that it will store your personal data for a reasonable period, determined on the basis of additional criteria. The criteria for determining the period are consistent with our desire to provide you with high-quality services, as well as the normal development of our partnership relationships.
When the personal data we collect are no longer necessary for the aforementioned purposes, we delete, anonymize or destroy them in another appropriate manner. In all cases, personal data is stored for a period not longer than the period specified in the relevant regulatory act.
Personal data provided through the inquiry form on the SITE is stored for the period from receipt of the inquiry, request or question until the purpose of their processing is achieved and/or the legal basis for the processing of the relevant personal data ceases to exist.
SECURITY OF PERSONAL DATA
Art. 13.: PROXIMA BG implements all appropriate technical and organizational measures to ensure the security of personal data, including minimizing the volume of processed personal data necessary to achieve the relevant purposes; timely restoration of the availability and access to personal data in the event of a physical or technical incident; taking an explicit obligation from employees for confidentiality, as well as other measures.
RIGHTS OF DATA SUBJECTS
Art. 14.: Every individual whose data is processed by PROXIMA BG has the following rights:
- the right to access his/her personal data, including to receive a copy of it;
- the right to correct or supplement inaccurate or incomplete personal data;
- the right to delete personal data that is processed without legal basis;
- right to restrict processing – in the event of a legal dispute between PROXIMA BG and the individual – until its resolution or for the establishment, exercise or defense of legal claims;
- right to object – at any time and on grounds relating to the specific situation of the person, provided that there are no compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or legal proceedings;
- right to portability – only in the event that personal data are processed automatically on the basis of consent or contract;
- the right not to be subject to a fully automated decision, including profiling, which produces legal effects concerning the data subject or significantly affects him/her.
In accordance with the GDPR and the PDPA, the above-mentioned rights may be exercised by submitting a written application electronically. The application is submitted personally by the data subject or by a person authorized by him. PROXIMA BG shall decide on the request of the data subject within 30 days of its submission.
Art. 15.: Right to have your personal data erased (right to be forgotten)
In certain circumstances, you have the right to request that your personal data be erased. Such circumstances are: – your personal data are no longer necessary for the purposes for which they were collected or otherwise processed; – if you have withdrawn your consent to the processing of your personal data; – if your personal data is processed unlawfully; – if you have objected to the processing of your personal data; – other cases provided for in the legislation governing the protection of personal data.
In some cases, we are obliged by law to store your personal data. In these cases, it will not be possible to delete your personal data from our systems.
PROTECTION OF THE RIGHTS OF DATA SUBJECTS.
